Hazardous Materials Endorsements

Q. When are drivers required to have a hazmat endorsement on their Commercial Driver's License (CDL)? And when must a trucking company have a hazmat endorsement?

A. . Hazmat endorsement is a part of the Federal Motor Carrier Safety Administration's rules for commercial driver's licenses. The requirements for endorsements for commercial drivers are found in 49 CFR 383.93. Under the regulations, drivers must have a commercial driver's license (CDL) with a hazmat endorsement when they are operating commercial motor vehicles that are:

  1. Double/triple trailers;
  2. Passenger vehicles;
  3. Tank vehicles; or
  4. Required to be placarded for hazardous materials per 49 CFR 172, Subpart F.

An operator's CDL and endorsements are obtained through the State.

Motor carriers are not required to have hazmat endorsements. However, the motor carrier may be subject to registration under the Department of Transportation rules at 49 CFR 107, if they ship:

  1. Highway route-controlled quantities of Class 7 radioactive materials; or
  2. More than 25 kg of Division 1.1, 1.2, or 1.3 explosives; or
  3. More than 1 liter per package of extremely toxic by inhalation materials; or
  4. Hazardous materials in bulk packaging with a capacity > 13,248 liters (~1,320 gallons); or
  5. Hazardous materials requiring a placard.

This registration is an annual requirement and includes the payment of a registration fee. DOT-PHMSA is proposing to raise the registration fee beginning in registration year 2009 (see below).

05/08/2008—Airline Industry Sees Fewer Fatalities
The International Air Transport Association (IATA) released its 44th annual Safety Report on May 8th, 2008. The report showed that the 2007 global accident rate of 0.75 hull losses for every million flights by Western-built jet aircraft was slightly higher than the 0.65 rate recorded in 2006. This was largely the result of tragic accidents in Africa, Indonesia and to some extent Brazil. IATA member airlines performed better than the industry average with an accident rate of 0.68 hull losses per million flights.

04/30/2008—Hazardous Materials: Fuel Cell Cartridges and Systems Transported on Board Passenger Aircraft in Carry-On Baggage
PHMSA is amending the Hazardous Materials Regulations (HMR) to permit certain fuel cell cartridges and fuel cell systems designed for portable electronic devices to be transported by passengers and crew in carry-on baggage on board passenger-carrying aircraft. This final rule does not limit TSA's authority to address security concerns related to the transportation of fuel cells or fuel cell systems.

04/16/2008—Hazardous Materials: Enhancing Rail Transportation Safety and Security for Hazardous Materials Shipments; Railroad Safety Enforcement Procedures; Interim Final Rule and Proposed Rule
The Pipeline and Hazardous Materials Safety Administration, in coordination with the Federal Railroad Administration and the Transportation Security Administration, is revising the current requirements in the Hazardous Materials Regulations applicable to the safe and secure transportation of hazardous materials transported in commerce by rail. This interim final rule fulfills requirements in Section 1551 of the Implementing Recommendations of the 9/11 Commission Act of 2007.
