Texas Adopts 3 Recent RCRA Revisions

Texas recently adopted three revisions to the Federal RCRA regulations made between 2015 and 2018. These newly adopted RCRA rules are effective in Texas as of June 11, 2020.

The hazardous waste rules Texas adopted are found on page 3780 of the document linked above.  

Comparable Fuels Exclusion

In 2015, EPA made two significant revisions to the regulations concerning comparable fuels and gasification rules. EPA removed the comparable fuels exclusion from 40 CFR 261.4(a)(16) and 261.38.

Secondly, the oil-bearing hazardous secondary material exclusion at 40 CFR 261.4(a)(12) was revised by removing gasification from the list of specific petroleum refining processes into which oil-bearing hazardous secondary materials may be inserted.

Hazardous Waste Import-Export

The 40 CFR regulations related to the import and export of hazardous waste changed in 2016. The changes make the RCRA regulations in 40 CFR Part 262 more consistent with the standards of the Organization for Economic Cooperation and Development (OECD).

The rulemaking also enables electronic submittal to EPA or import and export related documents like export notices and export annual reports.

Defective or Recalled Airbags

In November 2018, EPA published an Interim Final Rule to exempt defective airbags and airbag inflators from the RCRA hazardous waste management requirements. The rule aims to facilitate the return of defective or recalled airbag inflators from car dealerships, salvage yards, and other locations.
