PHMSA Issues Emergency Hazmat Waivers for Nebraska, Iowa Disaster Areas
To facilitate recovery in states affected by flooding and winter storms, namely Nebraska and Iowa, DOT PHMSA issued two Emergency Hazmat Waivers last month.
Emergency Waiver Order #12 was issued on March 22 and covers railroad carriers conducting operations within the Nebraska Severe Winter Storm, Straight-line Winds, and Flooding disaster area (DR-4420). The Order excepts railroad carriers from the requirements of 49 CFR 174.14.
- 49 CFR 174.14(a) requires rail carriers to forward hazardous material shipments within 48 hours of acceptance or receipt at any yard, transfer station, or interchange point, or on the first available train in certain situations.
- 49 CFR 174.14(b) contains specific requirements for rail shipments of flammable gases, poisonous gases, and flammable liquids.
Emergency Waiver Order #13 was issued on March 29 and covers persons conducting operations under the direction of EPA region 7 or the US Coast Guard within Nebraska and Iowa disaster areas.
The waiver will help EPA and USCG conduct emergency response activities, which include the safe removal, transport, and disposal of hazardous materials to protect the public from an actual or potential release that coudl harm human health or the environment.
