Cal DTSC Adopts Hazardous Waste e-Manifest Revisions

Changes proposed by California’s Department of Toxic Substances Control (DTSC) to adopt regulatory updates related to electronic hazardous waste manifests have been approved.

The (non-substantive) revisions to Title 22 of the California Code of Regulations (22 CCR) adopt new and modified language from the Federal RCRA regulations that established the e-Manifest system in 2018.

The updates take affect immediately. The approved regulatory text is available on DTSC’s website, as is DTSC’s letter requesting approval and the approval memo from the Office of Administrative Law.

EPA’s E-Manifest System

The e-manifest system, which is administered through EPA’s RCRAInfo web portal, has many benefits. One benefit is that physical copies of manifests to accompany hazardous waste shipments are no longer needed to comply with the hazardous waste regulations.

That said, US DOT still requires physical shipping papers for shipments of hazardous materials (including hazardous waste). Recently, DOT PHMSA requested public comments about the potential for using electronic hazard communications as an alternative to physical documentation.

Latest RCRA Action on e-Manifests

US EPA proposed a “Third Rule” to amend the regulations for e-Manifests in April 2022. The latest e-Manifest rule would expand manifest requirements to export shipments, integrate mandatory reports into the electronic system, revise reporting time limits, and make changes related to PCB wastes.
