TSCA Tuesday: CDR Deadline Extended & PFAS Reporting, and More

TSCA Chemical Data Reporting (CDR) Deadline Extended 

US EPA has postponed the deadline for chemical manufacturers and distributors to submit TSCA Chemical Data Reporting. Instead of the typical September 30 deadline this year, stakeholders have until November 22, 2024 to submit the TSCA CDR.

TSCA Reporting for Per- and Polyfluoroalkyl Substance (PFAS)  

US EPA shared two noteworthy updates concerning PFAS and TSCA compliance recently:

First, on September 5, EPA announced they are pushing back the reporting period for chemical manufacturers (including importers) to submit data about PFAS or PFAS-containing articles produced or imported since 2011. The 6-month reporting period will now begin on July 11, 2025.

Secondly, on September 30, EPA announced a request for comment from industry stakeholders about specific PFAS chemicals—PFOA, PFNA, and PFDA—which are produced or "manufactured" during the process of flourinating high-density polyethylene (HDPE) and other plastics. The deadline to submit comments is November 29, 2024.

Risk Evaluations and Rules: TCEP and 1-BP

US EPA has announced that the final risk evaluation for tris(2-chloroethyl) Phosphate (TCEP) is available. The final evaluation finds that TCEP poses an “unreasonable risk” to human health and the environment, setting the stage for restrictions on TCEP manufacture, processing, distribution, and/or use in the future. 

Regarding EPA’s proposed rule to address the risk from 1-bromopropane, the public comment period closed on September 23. After reviewing comments, the agency aims to issue a Final Rule in early 2025, per the Fall 2024 Unified Agenda.
