OSHA Challenged On New Silica Protections
Major industry groups filed suit in the US Fifth Court of Appeals this week to challenge OSHA’s new permissible exposure limit (PEL) for breathable silica. Among the challengers to the new OSHA silica rule is the ACG, the Associated General Contractors of America.

EPA Takes No Action on RCRA Corrosives Challenge
A few years ago, the Public Employees for Environmental Responsibility (PEER) challenged US EPA to tighten its standard for identifying corrosive materials under the Resource Conservation and Recovery Act (RCRA) hazardous waste rules. One year ago, a motion was reached thatrequired US EPA to review its RCRA standard for corrosive hazardous wastes and decide if a change was needed.

PHMSA Issues Lithium-ion Battery Prohibition Safety Advisory
The US DOT Pipeline and Hazardous Materials Safety Administration (PHMSA) today issued a safety advisory notice for individuals who prepare lithium battery shipments for transport and those otherwise involved in the transportation of lithium-ion or lithium-metal batteries.

Not Cool: Ice Cream Company Pays for Clean Air Act Violations
US EPA has cited a US ice cream maker for violations of the Clean Air Act Risk Management Plan (RMP) requirements. In a press release posted March 29, 2016, EPA alleges the ice creamery did not have an adequate Clean Air Act RMP or proper safety equipment for leak detection and ventilation on its refrigeration system.
