Texas Metal Fabricator Cited for Hazardous & Industrial Waste Violations

TCEQ recently issued a $11,812 civil penalty to a metal fabricator in Godley, TX for alleged violations of State hazardous and industrial waste regulations.

TCEQ conducted its investigation between August 2019 and March 2020. As a result of the investigation, TCEQ alleges the company:
  1. Caused, suffered, allowed, or permitted the unauthorized disposal of industrial solid waste (ISW).
  2. Failed to conduct hazardous waste determinations and waste classifications.

The metal manufacturer is required to implement procedures to prevent future unauthorized discharges of ISW, properly remove and dispose of contaminated soil, and conduct waste determinations and classifications for the site’s cutting and hydraulic fluids.

The company specializes in metal manufacturing for various industries, including oil and gas, aerospace, mining, and telecommunication.

Major RCRA Updates Coming to Texas in 2021–22

Texas’ effort to adopt updated RCRA hazardous waste regulations hit a major milestone last month, when TCEQ announced a schedule of deadlines to propose and finalize new hazardous waste rules under Title 30 of the Texas Administrative Code (30 TAC).

Key RCRA changes in the forthcoming proposal include:
  • EPA’s RCRA Hazardous Waste Generator Improvements Rule.
  • The Electronic Hazardous Waste Manifest (e-Manifest) Fee Rule.
  • Definition of Solid Waste (DSW) and recycling provisions changes.
  • New management standards for Pharmaceutical Hazardous Waste.
  • The addition of aerosol cans to the universal waste program.
If all goes according to plan, the new RCRA rules will take effect on January 6, 2022.
