TSCA Section 5 Review Periods Extended Due to Shutdown

Due to the recent and historically long Federal government shutdown, EPA has extended its review period for recently submitted Toxic Substances Control Act (TSCA) Section 5 notices.

The extension will impact TSCA Section 5 notifications that were submitted to EPA before December 29, 2018, for which the review period had not expired as of December 29, 2018. EPA’s extension of the review period will also extend the period before manufacturing or processing of the chemical substances subject to these reviews may begin.

TSCA Section 5 Notices affected include:
  • Premanufacture notices (PMN), 
  • Significant New Use Notices (SNUN),  
  • Microbial Commercial Activity Notices (MCAN), and
  • Exemption notices.
The extension was published in the Federal Register on February 8, 2019.

EPA fully resumed its TSCA work on January 31, 2019. The extension period is 33 days long, equaling the time EPA lost during the government shutdown. EPA reserves the right to further extend additional individual cases for a total of up to 90 days.

EPA is authorized by TSCA Section 5(c) to unilaterally extend the notice review period for PMNs, MCANs, and SNUNs.
