EPA Proposes Revised Definition of Solid Waste

Today, the Federal Register published the EPA’s latest attempt to redefine solid waste in a way that safeguards public health and the environment while also promoting the recycling of hazardous materials.
 
Today’s rule proposal was first announced over a week ago when Administrator Jackson signed the proposal just in time to comply with a consent decree between the Sierra Club and the Agency.
 
The major changes in this proposal, compared to the October 2008 final rule are:
 
  • A severe curtailment of the transfer-based exclusion,
  • An official regulatory definition of “containment,”
  • Redifining “legitimate” recycling, and
  • Extending the legitimacy test to all existing solid waste exclusions.
 
In addition to the proposal, the EPA is also making over a dozen studies, reports, and other supporting material available in the regulations.gov docket for this rule.
