Spring 2022 Regulatory Agenda Released

The Office of Information and Regulatory Affairs (OIRA) just released the Spring 2022 Unified Agenda of Regulatory and De-regulatory Actions. The semi-annual Agenda details new regulations that Federal agencies like US EPA, US DOT, and OSHA have planned for the near future.

Lion Members can login view a Member Bulletin that breaks down the environmental, hazardous materials, and health & safety regulations on the way 2022—23. The Bulletin covers what’s in the new regulations that these agencies have planned, and when to expect proposals and Final Rules. 

Rules to Watch in 2022—23

Hazardous materials shipping and transportation regulations on the horizon include:

• Two forthcoming rules to harmonize the 49 CFR Hazardous Materials Regulations (HMR) with evolving international standards,  
• Several regulations that will impact lithium battery shipments,
• Adoption of industry stakeholder petitions to clarify and simplify compliance, and
• Reconsideration of a July 2020 rule that authorized transport of liquefied natural gas by rail.

Environmental and hazardous waste rulemakings planned for 2022—23 include:

• Emergency planning requirements for worst-case discharges of hazardous substances,
• Several rules related to PFAS under CERCLA and EPA's water programs, 
• A revised definition of Waters of the United States (WOTUS), and
• A Final Rule to officially finalize management reliefs for recalled airbags.

OSHA is working to complete many workplace health and safety regulations, including:

• Updates to the Hazard Communication Standard (HCS), Emergency Response Standard, and Lockout/Tagout requirements,
• A rule to amend the standards for injury and illness reporting,
• New requirements to protect health care employees from infectious diseases like tuberculosis, measles, SARS, and COVID-19.

Develop a step-by-step process to ship hazardous materials/dangerous goods by ground and air, in full compliance with US DOT and international regulations. These upcoming workshops are built to help satisfy 49 CFR (DOT) and IATA DGR training mandates for shippers and "hazmat employees."

US DOT requires training once every 3 years for all hazmat employees (49 CFR 172.704).
For air shippers, the IATA DGR requires training once every 2 years (IATA DGR 1.5)
