New PHMSA Hazmat Special Permits and Applications

CFR-and-hazmat-package.gifThe DOT Pipeline and Hazardous Materials Safety Administration (PHMSA) on May 10 posted notice of applications for new hazmat special permits and Agency decisions regarding existing special permits applications.

PHMSA officially codified its standard operating procedures for evaluating hazmat special permits in September 2015.

New Hazmat Special Permit Applications

Among the new hazmat special permit applications posted to the Federal Register on May 10 are requests to: 
 
  • Modify permits to add materials, packaging types, product designs, or approved carriers.
  • Authorize the transportation in commerce of hazardous materials for about 2,400 feet without proper hazard communication.  
  • Harmonize special permits with revised requirements in DOT’s HM-215N rulemaking.

Hazmat Special Permits Granted

PHMSA granted eight hazmat special permits, including one “to authorize the transportation of cargo tanks manufactured after August 31, 1995 for which the Manufacturer’s Certificate of Compliance is missing” and another “to authorize the transportation of heat pipes containing anhydrous ammonia by cargo-only aircraft.”

Hazmat Special Permits Denied or Withdrawn

PHMSA denied multiple permits from a technology company seeking to modify its special permit “to authorize UE testing of approved Canadian cylinders” and denied a request related to transport of “LPG railcars not subject to the 48-hour expedited movement requirements.”
