Ohio Industrial Shop Cited for Storing 38K Pounds of Hazardous Waste

Three operators of a defunct plating shop face felony charges for allegedly storing hazardous waste and operating a hazardous waste facility without a license.

During inspections on March 24 and 26, Ohio EPA allegedly identified at least 38,000 pounds of hazardous waste at the site. This includes at least 8,000 gallons of liquid waste supposedly used in the plating process at the facility.
 

Under RCRA, individuals who knowingly treat, store, or dispose of a hazardous waste without a permit can face up to 5 years in prison and criminal penalties of $50,000 per day, per violation (42 USC 6928(d)).

Among the waste, Ohio EPA found five 55-gallon containers containing corrosive, chromium, or cadmium waste. Investigators also noted solid chromium located on the floor around the containers as well as cadmium in the facility’s wastewater treatment tank and floor sump.

The facility where the hazardous waste was allegedly stored is the site of a dilapidated garage that used to house a plating company. The facility has recently been recognized by US EPA as a Superfund site, indicating that long-term remediation may be required.

Separate criminal proceedings are underway for two business operators and a former business operator on charges related to Ohio EPA’s alleged findings.

Ohio EPA has requested the facility undertake necessary measures to return to full compliance within two weeks of receiving that citation. At that point, the company must submit documentation on steps taken to achieve compliance.
