Effective May 14, 2022, Montana has incorporated significantly revised Federal hazardous waste regulations into its state requirements (Rule 17.53.105). References to US EPA’s RCRA regulations in the Administrative Rules of Montana (ARM) now refer to the regulatory text in effect as of July 21, 2021.
Significant updates for hazardous waste generators include:
Adoption of EPA’s Generator Improvements Rule
Adoption of new standards for managing Hazardous Waste Pharmaceuticals (HWP)
Addition of hazardous waste aerosol cans to the universal waste program
Revisions to the Definition of Solid Waste (DSW) that impact recycling
New management standards for recalled/defective airbags
Also included in this action are changes to EPA’s hazardous waste regulations affecting test methods for ignitable hazardous waste, disposal of coal combustion residuals (CCR), exporting cathode ray tubes (CRTs), and imports/exports of hazardous waste.
