DOT Announces 49 CFR Regulatory Review, Wants Your Input

Truck_Highway_163311605.jpgIn the Federal Register on Monday, October 2, the US Department of Transportation (DOT) announced the start of a regulatory review to evaluate the necessity and effectiveness of existing 49 CFR regulations, including hazardous materials shipping requirements found in 49 CFR 100—181 et al.

DOT is requesting public input on 49 CFR requirements that should be revised or revoked. For information on submitting your comments and recommendations, read the Federal Register release, here.

US DOT has a procedure in place to review its regulations once every ten years. This latest review is spurred at least in part by an Executive Order signed by the President earlier this year, which ordered Federal agencies to eliminate two existing regulations for each new one created.

In Appendix A to the Federal Register announcement, US DOT lists economically significant rulemakings—which they says may “provide the greatest opportunity for alleviating unnecessary burdens.” Among these is PHMSA’s 2015 Final Rule to bolster the standards for rail tank cars that transport crude oil and other flammable liquids.
