EPA Denies Petition to Extend Air Pollution Deadline in San Joaquin Valley, California
In the Federal Register this week, US EPA announced it has denied a petition from the California Air Resource Board (CARB) requesting an extension for the San Joaquin Valley region to come into attainment of the EPA’s 1997 National Ambient Air Quality Standards (NAAQS) for small particulate matter.

Coal Company to Pay $900,000 for Alleged Clean Water Act Violations
A coal company with mining and processing facilities in Alabama, Kentucky, Tennessee, Virginia, and West Virginia has to pay a $900,000 civil penalty to resolve US EPA allegations that the company violated the Clean Water Act.

Sulfur Dioxide Release Leads to $106,000 in EPA Fines
US EPA reported this week that a Carson, California facility that produces sulfuric acid for refineries will pay a $106,000 civil penalty following a release of sulfur dioxide that hospitalized eleven people working at neighboring sites.

PHMSA Issues Emergency Prohibition Order Against Lithium Battery Manufacturer
After identifying multiple violations of hazardous materials law and regulations by a lithium battery manufacturer, the US DOT Federal Aviation Administration (FAA) issued an emergency prohibition order to halt the company from shipping non-compliant batteries.

EPCRA Reporting Violations Net Rhode Island Metal Producer $69K in EPA Fines
For violations of US EPA chemical reporting requirements under the Emergency Planning and Community Right-to-Know Act (EPCRA), a Rhode Island facility that manufactures metal products like filler metals, fluxes, products for brazing and soldering metals, and more will pay a $69,265 fine.

25 Common RCRA Mistakes to Avoid
Recently, the EPA increased its maximum civil penalty for hazardous waste violations to $70,117. That said, EPA does not assess the maximum penalty for every violation. When laying penalties, the US EPA’s RCRA Civil Penalty Policy (based upon Section 3008 of RCRA, 42 U.S.C. § 6928) takes into consideration the seriousness of a violation, any good-faith efforts to comply with applicable requirements, and other factors to calculate an appropriate monetary penalty.
