PHMSA Proposes New Regulations for Cargo Tanks

On March 11, 2011 at 76 FR 13313, the U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration proposed to amend the Hazardous Materials Regulations to mandate that facilities where cargo tanks are loaded or unloaded must perform risk assessments, develop safe operating procedures, and provide annual safety training for employees.

The safe operating procedures required by this rule include:
  • Pre-transfer checklists
  • Temperature and flow rate monitoring
  • Emergency response plans
  • Design, testing, and maintenance standards for transfer equipment
  • Facility oversight of carrier personnel
DOT-PHMSA will be accepting comments on this rule proposal until May 10, 2011.
