Final Rule Alert: EPA's RCRA Generator Improvements Rule

UPDATE 11/28/16: EPA’s RCRA hazardous waste Generator Improvements Rule was published in the Federal Register today, Monday, November 28, 2016. See the Final Rule here.

On Friday, October 28, US EPA officially finalized its long-awaited RCRA Hazardous Waste Generator Improvements Rule.

The “new” RCRA regulations will have a major impact on the way your site manages and disposes of hazardous waste. Some of the updates create more stringent requirements for generators, while others provide new or additional relief from the RCRA regulations.

Arguably the two biggest changes in the finalized RCRA Generator Improvements Rule are:

  • A wholesale re-organizing and re-structuring of the hazardous waste generator rules in 40 CFR 262 to make the regulations easier to navigate and understand; and 
  • Providing relief for episodic events that may result in a change of generator status.

The complete list of changes in this RCRA Final Rule is massive; the Final Rule stretches over 300 pages. The RCRA Generator Improvements Rule is one of the most significant hazardous waste rulemakings promulgated since EPA added satellite accumulation options in 1984 and rules for small quantity generators in 1986.
