New PHMSA Hazmat Enforcement Policy for Air and Sea Shippers

On October 1, US DOT PHMSA released a hazmat enforcement policy to permit offerors and carriers to comply with editions of the ICAO Technical Instructions (TI) and the IMDG Code that have not yet been incorporated into the 49 CFR Hazardous Materials Regulations (HMR) when shipping by air and vessel.

The policy reads, in part: “PHMSA will not take enforcement action against any offeror or carrier who offers or accepts for domestic or international transportation by any mode packages marked or labeled in accordance with these standards.”

PHMSA will evaluate whether to include revisions in the 2021-2022 ICAO TI and/or the forthcoming Amendment 40-20 of the IMDG Code in a future rulemaking. 

2021 IATA DGR (62nd Edition)

Most hazmat/dangerous goods air shippers use the International Air Transport Association’s Dangerous Goods Regulations (IATA DGR) to prepare and offer hazardous materials shipments. The IATA DGR combines the ICAO Technical Instructions with state and operator variations that hazmat air shippers must know for their shipments to be accepted for air transport.

2018 IMDG Code

The International Maritime Organization publishes a new edition of its International Maritime Dangerous Goods Code (IMDG Code) every other year. The 2018 edition IMDG Code (Incorporating amendment 39—18) is mandatory for 2020 and may be used until the end of 2021.
