EPA Raises Civil Penalties for Environmental Noncompliance
In the Federal Register today, the US Environmental Protection Agency (EPA) posted an Interim Final Rule to raise civil penalties for violations of environmental law and EPA regulations. Penalties are being raised to match inflation as mandated under the Federal Civil Penalties Inflation Adjustment Act of 1990.6/30/2016
Brewery Fined $2.8 Million for Clean Water Act Violations
In a June 23 press release,US EPA announced a consent decree between EPA, the US Department of Justice, and a beer brewer that operates two large-scale breweries in Pottsville, Pennsylvania. According to the press release, the brewer allegedly violated the Clean Water Act by discharging industrial waste to municipal publicly owned treatment works (POTWs).6/21/2016
Clean Air Act, CERCLA, and EPCRA Fines for Food Processor
For alleged violations of multiple US environmental laws and regulations stemming from a release of anhydrous ammonia, a bakery and distribution company in Chelsea and Lawrence, MA will pay $156,000 in civil penalties. In addition to the fine, the company will furnish emergency response equipment to local emergency responders, at an estimated cost of $119,000.6/9/2016
$23,000 PCB Storage Penalty for Lamp Recycler Under TSCA
According to a US EPA press release, a lamp recycler in Windsor, CT will pay $23,000 to settle allegations personnel mishandled PCB-containing light ballasts. PCBs—polychlorinated biphenyls—are known carcinogens subject to specific handling and management rules under the Toxic Substances Control Act (TSCA).6/1/2016
Kansas Foundry Could Pay $28,975 for Stormwater Violations
To settle allegations it violated the Clean Water Act stormwater requirements, a foundry in Coffeyville, KS will pay $28,975 and fund/implement a Supplemental Environmental Project (SEP) valued at $600,000. The settlement is open to public comment at EPA’s website, here.

Electroplating Operator Indicted for RCRA Storage Violations
The former operator of a now-closed electroplating facility in Cedar Falls, IA has been indicted by a Federal grand jury on one count of unlawful storage of hazardous waste stemming from the discovery of drums of toxic and corrosive waste stored at the facility after it closed.5/27/2016
