Two Texas Businesses Pay $74K for IHW Violations

This month, The Texas Commission on Environmental Quality (TCEQ) approved enforcement actions against two businesses for allegedly violating Texas' unique requirements for industrial and hazardous waste management and disposal.

A facility that performs maintenance on oil field vehicles and machinery faced a $34,221 civil penalty for allegedly mishandling used oil and other chemicals with proper authorization. The enforcement action concerns twenty-two shipments of Class I industrial waste that were sent to unauthorized facilities for disposal.

TCEQ also alleges that the facility failed to make a proper notification of generation and disposal of industrial solid waste (ISW).   

TCEQ also approved a penalty of $37,362 for a dewatering and compost processing plant in San Patricio County for allegedly accepting industrial wastewater sludge for disposal without proper authorization.

On both enforcement actions, the civil penalties were “enhanced” to capture the avoided compliance costs.

TCEQ proposed significant increases to its penalty policy for environmental and hazardous/industrial waste violations in September 2020.

Latest RCRA Rule Updates for Texas

Hazardous waste generators in Texas—and elsewhere—are waiting for the state to adopt major changes to the RCRA regulations from EPA’s 2016 Generator Improvements Rule. Texas is working on it.

A rulemaking project is in progress now in Texas to adopt the RCRA Generator Improvements, under Project Number 2019-086-3350-WS. Lion continues to monitor hazardous and industrial waste news from Texas and will update you when a proposed rulemaking is available.

In addition to adopting changes made in the 2016 Generator Improvements Rule, the rule project will revise Title 30 of the Texas Administrative Code, Chapter 335 (30 TAC 335) to incorporate new Federal regulations for hazardous waste pharmaceuticals and EPA’s 2018 Definition of Solid Waste Rule.

In June 2020, Texas adopted three revisions to the RCRA hazardous waste regulations made by EPA between 2015 and 2018. Among the rules adopted is the exemption from RCRA for defective airbags and airbag inflators
