PHMSA Extends Enforcement Discretion for Hazmat Cylinders

Some shippers of medical and industrial gases are still struggling to find cylinders to fill and ship.

To ease this supply chain bottleneck, PHMSA will continue to allow shippers to offer Division 2.2 hazardous materials (non-flammable gases) in cylinders that are no more than 12 months overdue for periodic requalification, provided that the cylinder meets all other requirements of the Hazardous Materials Regulations (HMR).  

PHMSA alerted stakeholders recently that they will extend their enforcement discretion for cylinders until May 16, 2022.

PHMSA issued the policy in April 2020 in response to unprecedented supply chain pressures and uncertainty during the first weeks of the COVID-19 pandemic. The enforcement discretion has been extended several times since (See the April 2020 Notice).
