DOT Seeks Stakeholder Input on Hazmat Registration for Shippers and Carriers

US DOT’s Pipeline and Hazardous Materials Safety Administration (PHMSA) is asking for stakeholder input about its registration program for hazardous materials shippers and carriers. An Advanced Notice of Proposed Rulemaking appeared in the Federal Register on September 22.

To fund US DOT's national emergency preparedness grant program to levels required by law, the Agency may need to increase fees or expand the criteria for who must register. 

PHMSA will accept public comments until December 21, 2022. Comments from stakeholders will be considered before the agency proposes any amendments to the registration program or fee schedule. Comments can be submitted through the regulations.gov rulemaking portal.

Who Must Register with DOT?

A shipper or carrier must register with DOT if they offer/transport any load that requires a placard. For shippers, this means that if an empty truck or rail car is loaded at your property and now requires a placard, then you must be registered with DOT.

Per 49 CFR 107.601, registration with US DOT is required to offer or transport:

  • A highway route-controlled quantity of radioactive material (Class 7);
  • More than 55 pounds (25 kg) of a Division 1.1, 1.2, or 1.3 explosive;
  • More than 1 L per package of extremely toxic by inhalation materials (Hazard Zone A);
  • Any shipment of hazardous materials in bulk packagings with a capacity equal to or greater than 3,500 gallons for liquids or 468 cubic feet for solids;
  • Any shipment in non-bulk packagings with a total gross weight of 5,000 lbs. or more of a class of hazardous materials for which placarding is required; or
  • Any other shipment that requires hazmat placards.

The registration (DOT Form 5800.2) provides information about the type of shipments you will offer or transport during the year. 

2022-2023 Registration Period Open Now

The registration period begins on July 1 and extends until June 30 of the following year. If a business will ship or transport even one shipment that meets the criteria above during that period, registration is required. Hazmat registrations must be updated/renewed regularly and are due by June 30 each year.

Registration can be completed either online or by mail.

Shippers and carriers can register for a one-, two-, or three-year period. The fees for the current registration period are as follows:

Federal and State agencies, farmers, and certain foreign entities are partially exempt from the registration program (49 CFR 107.606 and .601(b)).

33,825 entities filed hazardous materials registrations for the 2021–22 period and collectively paid about $25 million in fees.
