First 10 TSCA Risk Evaluations Move Foward, EPA Proposes Historic Asbestos SNUR
US EPA on June 1 released problem formulations for each of the first ten chemicals up for risk evaluation under the revised TSCA requirements. These documents “clarify the chemical uses that EPA expects to evaluate and describe how EPA expects to conduct the evaluations.”

PHMSA Relaxes Position on Hazmat Package Closures and Tape
In May 2018, the Pipeline and Hazardous Materials Safety Administration (PHMSA) issued a new interpretation of the 49 CFR hazmat rules to clarify the agency’s position on package closures. In the past, PHMSA has held that “changing the size (e.g., width) of tape from that specified in the packaging test report and closure notification constitutes a change in design.“

In the Federal Register on May 23, US DOT’s Pipeline and Hazardous Materials Safety Administration (PHMSA) requested input from hazardous materials emergency responders regarding updates to the forthcoming 2020 edition of the Emergency Response Guide (ERG).

4 New Hazmat Rules to Watch for in 2018-19
On May 10, 2018, PHMSA, along with other Federal Agencies, published its Regulatory Agenda for Spring 2018. That Agenda lists a handful of new rules pertaining to hazardous materials transportation safety, which PHMSA plans to promulgate in the second half of the year.
