DOT Proposes Update to Rules for ID Numbers on Cargo Tanks Carrying Fuels
In today’s Federal Register, the US DOT Pipeline and Hazardous Materials Safety Administration (PHMSA) proposed a rule to update the hazardous materials marking requirements for cargo tanks that carry petroleum-based fuels. The proposal is a direct response to the Protecting our Infrastructure of Pipelines and Enhancing Safety Act, or PIPES Act, signed into law in June 2016.

FMCSA Safety Advisory: Cargo Tank Motor Vehicles
On November 10, 2016, the Federal Motor Carrier Safety Administration issued a Safety Advisory to notify owners and operators of DOT 407 and DOT 412 cargo tank motor vehicles (CTMVs) manufactured by a company called Keith Huber Incorporated.

PHMSA Issues Guidance for Shipping Organic Peroxides, Self-Reactive Materials
Earlier this year, the US DOT Pipeline and Hazardous Materials Safety Administration (PHMSA) finalized a rule to remove the Packing Group II (PG II) designation for organic peroxides and self-reactive substances. The change was among many “miscellaneous” hazmat updates made in a Final Rule posted to the Federal Register on June 2, 2016. The new rule has been in effect since July 5.

Federal Judge Halts California's Hazmat Rail Fee
On October 29, Union Pacific released a customer announcement stating that a Federal judge has issued an injunction to temporarily halt the implementation of California’s hazmat rail fee. Passed in August, the fee of $45 per rail car would apply to rail shipments of 25 specific hazardous materials commodities, including petroleum crude oil (UN 1267 and 1270), gasoline (UN 1203, 1993, and 3295), and liquefied petroleum gas or LPG (UN 1075 and 3161).

Railroads Challenge California Hazmat Rail Fee
In August, the state of California passed a law to require railroads to collect a $45 fee to transport rail cars carrying certain hazardous materials. Railroads are now challenging the implementation of the hazmat fee, expressing concerns about how it will be enforced and how it will affect small quantity shipments.

PHMSA Releases Safety Advisory for Defective or Damaged Lithium Batteries
The US DOT Pipeline and Hazardous Materials Safety Administration (PHMSA) today posted a safety advisory to the Federal Register to inform the public of the hazards posed by defective, damaged, or recalled lithium batteries and devices containing these batteries.

NMFTA Updates Bill of Lading Standards
New standards for Bills of Lading (BOL) used in ground transportation of less-than-truckload (LTL) shipments took effect on August 13, 2016. They affect the Uniform Bill of Lading, the Straight Bill of Lading, and the Straight BOL-Short Form. US shippers and carriers should review the updated requirements, which are found in Supplement 2 of the National Motor Freight Classification (NMFC) version NMF 100-AP.
