Delaware Adopts New Hazardous Waste Regulations

Major changes to the Delaware hazardous waste regulations took effect on January 21, 2021.

To maintain authorization under RCRA, Delaware recently adopted the Generator Improvements Rule and other Federal hazardous waste updates.

Delaware adopted the following RCRA rulemakings into its state hazardous waste regulations:

  • Hazardous Waste e-Manifest Fee Rule (Learn more)
  • Safe Management of Recalled Airbags (Learn more)
  • Management Standards for Hazardous Waste Pharmaceuticals and Amendment to P075 listing for Nicotine (Learn more)
  • Increasing Recycling: Adding Aerosols to the Universal Waste Rule (Learn more)

Why Did Delaware Update the Hazardous Waste Regulations?

Like most states, Delaware is authorized to run its own RCRA hazardous waste program. To stay authorized, states must maintain regulations that are at least as stringent as the Federal requirements.

EPA’s 2016 Generator Improvements Rule overhauled the Federal hazardous waste regulations, adding new, more-stringent requirements for container labeling, contingency planning, notification and re-notification, recordkeeping, and more.

The Rule also re-organized the generator regulations in 40 CFR Part 262 and added some new reliefs, including an exception for episodic events (e.g. spills, lab clean outs) that generate hazardous waste.

Delaware’s state hazardous waste regulations are found in Title 7 of the DE Administrative Code, Part 1302.

Not First, Not Last

The First State was not first this time. Delaware becomes the thirty-third state to adopt the Generator Improvements Rule. Other states to recently adopt the major RCRA updates including Nevada, Ohio, Michigan, Wisconsin, and Arkansas.
