New York Proposes Adding Two Universal Wastes

proposed rule published on November 9, 2022 would add two new universal wastes to New York’s state hazardous waste program—aerosol cans and paint.

If finalized, the rule will streamline the management of these two common wastes in New York and encourage recycling and proper disposal. The proposed rule revises Part 370 of 6 NYCRR to add aerosol cans and paint to the existing list of universal wastes.

The rule would amend the state generator requirements to exempt these wastes from many typical hazardous waste management requirements when they are properly managed under new universal waste standards.

The proposed rule also adds definitions for key terms “aerosol can,” “architectural coating,” and “paint.” The definitions of “universal waste” and “universal waste handler” will be modified to include the two new universal wastes.

NYSDEC will accept public comments on the proposed universal waste rule until January 17, 2023. A public hearing on the proposal will be held on January 11 at 2 PM ET, via Webex.
