Alabama, North Carolina, and Virginia Adopt New RCRA Hazardous Waste Rules

rcraclipboard.JPGThree more states recently adopted EPA’s major updates to the RCRA hazardous waste standards into their State regulatory codes. The RCRA Generator Improvements Rule took effect in North Carolina on March 1, 2018; in Alabama on April 6, 2018; and in Virginia on April 8, 2018.

By adopting the revised RCRA updates, these three states join New Jersey, Pennsylvania, Alaska, Iowa, Utah, Georgia, and Kentucky as states in which the new rules are in effect now.

When Will My State Adopt the RCRA “Generator Improvements”?

EPA’s Generator Improvements Rule took effect on May 30, 2017. US states have 1 to 2 years from that date to adopt updates to the hazardous waste regulations. EPA has made available a list on its website with relatively up-to-date information regarding states’ plans to adopt the Generator Improvements Rule.

States must adopt the elements of the Final Rule that are more stringent than current State rules or risk losing their authorization to run an independent hazardous waste program. States may or may not adopt new reliefs and exemptions added to the Federal RCRA regulations.
