OSHA and Cal/OSHA Update Operational Enforcement Agreement

OSHA announced on June 2 a revised Operational Status Agreement between the Federal agency and California’s OSHA State Plan.

osha-inspection.jpgUnder the updated operational agreement, Federal OSHA “gains coverage of private and tribal employers on US-government recognized Native American reservations and trust lands.”

California’s State OSHA Plan retains authorization to oversee work safety for most private employees in California, public employees, and maritime industry workers. Federal OSHA, meanwhile, is still responsible for private employers on military installations and Federal parks. 


The 3 Types of OSHA State Plans

US states implement OSHA work safety regulations in 3 ways. They may have no plan, in which case Federal OSHA oversees employers in the state—creating safety standards, carrying out inspections, and assessing fines and violations.

States may have a “partial” plan, in which case the State plan covers only public employees. In these states, Federal OSHA oversees work safety at all private employers.

OSHAStatePlanMap.JPGLastly, stats may adopt a “full” OSHA State Plan. Under full OSHA State Plans, states oversee work safety enforcement—including inspections, outreach, and enforcement. Currently, 22 states, including California, have full OSHA State Plans.
